Where is the GPS unit located in my van?
My work just informed me that the gps unit on my Ford E350 Super Duty XL isn't working. They want me to find the unit, check to make sure it's working, and give them its serial number. Problem is, I can't find it! I have no display or anything, the unit simply tells work where I am. Anybody know what these things look like or where it might be placed inside or outside the van?
The GPS is how they track my hours. I'm not trying to find the thing to disable it! My company is in Tallaassee FL and I'm in Missouri, so they can't help me. CME, your answer makes no sense. As stated in my question, it's not working and I have to find it to see if it's powered on and to make sure they have the correct serial number. That's all.
If its the type of unit that is installed by a company to track its workers, then it is designed not to be found !!! Your company might have to contact the company or individual who installed it.
Some of these devices are small and can be on the inside or the outside of the vehicle, they also require very little power and can run on the power of the stereo speaker wire when music is played. With that said anywhere where there is wires, can be this device. (Trunk, underhood, behind dash, under drivers seat)
The New York State Court of Appeals overturned decisions on the Scott Weaver case based on evidence obtained by using a GPS device without a warrant on Weaver's vehicle. The unit was in place for 65 days, during which Weaver allegedly committed two acts of burglary.
Although the conviction did not at all hinge on the information gained by the tracking device, Weaver will receive a new trial with the GPS evidence excluded.
The ruling will not be appealed through federal courts as the decision was made under the New York constitution and as the panel stated, only applies to New York.
The main issues are an expectation of privacy and protections against unreasonable searches. In his opinion, Chief Justice Lippman wrote, "The massive invasion of privacy entailed by the prolonged use of the GPS device was inconsistent with even the slightest reasonable expectation of privacy." He continued with, "GPS is not a mere enhancement of human sensory capacity, it facilitates a new technological perception of the world in which the situation of any object may be followed and exhaustively recorded. Without judicial oversight, the use of these powerful devices presents a significant and, to our minds, unacceptable risk of abuse."
It was a close 4 to 3 decision, but in the end, Weaver prevailed.
The idea that police found it appropriate to use tactics like placing GPS tracking devices on cars without probable cause is a bit much. The court's decision is reassuring to some extent that there will be some checks and balances i.e. warrant requirements in the future- at least in New York anyways. According to timesunion.com, Associate Judge Pigott offered that people should put "no trespassing" stickers on their bumper to ward of cops.
Cases pertaining to the use of GPS devices are making their rounds through federal appeals courts now, but currently there is no federal law or statute regarding the practice.
On the same note, the 4th Circuit Court of Appeals in Wisconsin had an antithetical ruling. In that case, the police tracked a man accused of stalking with a GPS device obtained with a warrant (hey finally! Some probable cause!). Until a federal law is passed, which would probably require more attention given to the subject by the media and others, the field is ripe for exploitation. As innocuous as a GPS tracker may seem, it is definitely different than police surveillance. Mainly, it is cheaper. So police who always "had their suspicions" about Joe Blow but didn't have enough reason to go to their sergeant, form a task force, and command station resources to pursue their 'suspicions' can now track whomever they so choose for pennies on the dollar.
